Brief Introduction on Transitional Period of Infant Formula FSMP
CFDA has clearly defined the transitional period of Infant Formula Food for Special Medical Purpose (FSMP), and this article briefly introduces several points of understanding:

1. January 1, 2018 is the deadline, before which all the products produced in China and approved to be imported upon approval from related departments may be sold until their expiration date.

2. All the product after above mentioned day must obtain the formula registration certificate approved by CFDA. Without such certificate, the domestic enterprises shall halt the production, and the products from foreign enterprises are not allowed to be imported to China.

3. January 1, 2018, for domestic enterprises it means the production date; and for import business it refers to the issuing date of CIQ certificate, so the date goods clearance of will be in November which is one month ahead, wherein this is only the schedule of the air transportation…

The promotion of infant formula milk powder registration is accelerated, and enterprises should grasp several principles
Recently, China Food and Drug Administration has released the Technical Guiding Principle on the Labeling Specifications for the Formula Registration of Infant Formula Milk Powder Product (Trial Implementation), and the Application Materials and Requirements for the Formula Registration of Infant Formula Milk Powder Product (Trial Implementation) (2017 Revision). This “Dragon Boat Festival Gift Pack” expected by the whole industry finally have met everyone, and the dairy industry partners having a short rest have to pack their bags and keep fighting. On the next day of the documents release, the first National Special Food Registration, Supervision and Management Work Conference since the establishment of CFDA was held in Beijing, which made a comprehensive deployment on the registration and management work of special food registration and had a huge information contents. On July 26, 2017, the 2017 China Health Food Industry Conference cosponsored by China Nutrition and Health Food Association and Chinese Nutrition Society was held in Beijing. The conference has comprehensively summarized and analyzed the development achievements and problems of China’s health food industry, publicized and implemented the newly published laws and regulations, advocated the industry self-discipline and normative development, and enhanced the understanding and awareness of consumers on health food. Sun Xianze, the deputy director general of China Food and Drug Administration attended the conference and made an important speech.
Sun Xianze pointed out that: The safety of health food concerns the health of the broad masses of the people. China Food and Drug Administration pay high attention to it all the time. We shall conscientiously carry out the spirit of the important speech from General Secretary Xi Jinping as well as requirements of the important instructions “the Four Most Strict Things”, and put the registration and supervision of health food to an more important place. With the joint efforts of food safety supervision departments in each level, the production and operation units, various industry organizations and all sectors of society, the health food safety has been kept in a stable and positive situation. For the year of 2016, the overall sample qualification rate of supervision spot check is 98.1 %, which has a 1.6 and 4.2 percent points of increase in comparison with 2015 and 2014 respectively.
In the meantime, the health food supervision still has a certain gap with the public expectation, and is also facing some challenges. It mainly reflects that some enterprises are still producing, operating and importing health food without permit, making false and overstated publicity, illegal marketing and fraudulent sales via internet, conference, telephone, television and etc., claiming false identification functions on product labels, and illegally publishing health food advertisement, and etc. Especially, the fraudulent conducts against middle-aged and elderly people and patients haven’t been fundamentally contained yet.
The supervision departments in each level will organize the overall examination on the food and health food production and operation enterprises, as well as the non-physical-store operation units, strengthen the casual inspection on the products via internet sales, conference sales, TV shopping and telemarketing, lay more emphasis on making casual inspection on the products suspected as illegal addition or illegal efficacy claim, increase the degree of punishing the misleading propaganda and illegal function claiming advertisement, and take stern actions against the misleading propaganda and the publicity of disease prevention and treatment efficacy and other illegal behaviors, wherein any suspected crime will be transferred to the public security organ for investigating the criminal liability.
Sun Xianze expects the health food production and operation enterprises to really undertake the responsibility of the first person responsible for quality and safety by special rectification opportunity from the nine governmental departments, so as to jointly maintain the overall image of the health food industry. Meanwhile, he also expects China Nutrition and Health Food Association and other industry organizations to further give play to the function of bridge and link between the government and enterprises, actively guide the industry self-discipline, forcefully boost the construction of credit system, and drive the healthy and sustainable development of health food industry.
On the conference, the officers from Special Food Registration Management Division and Inspection Department of China Food and Drug Administration respectively made speech on the thoughts and requirements of the health food registration and record management, health food advertisement censoring system and other contents; National Institutes for Food and Drug Control, CFDA Health Food Review Center, China National Center for Food Safety Risk Assessment, National Institute for Nutrition and Health Chinese Center for Disease Control and Prevention made a special sharing on the topics such as health food function evaluation, detailed rules of health food registration and record management, health food standards and requirements on the use of food additives, nutrition and health conditions of Chinese residents, health food development and etc. Meanwhile, the officers from International Alliance of Dietary/Food Supplement Associations (IADSA) and United Natural Products Alliance (UNPA) respectively introduced the contribution of food supplement / health food on reducing the medical expenses and the law and regulation system of US and Canada natural food.
Liu Xuecong, the secretary general of China Nutrition and Health Food Association initiated the self-discipline development initiatives “Conscientious Production and Management Serving the Healthy China” for China health food industry, which resolutely implements the basic principle of quality first, sticks to the honesty and self-discipline and fulfilling our social responsibility, insists the brand strategy to strengthen the comprehensive competitiveness. The leaders of Guangdong, Zhejiang, Jiangsu and the other 8 provincial local industry associations and China leading health food production and operation enterprises jointly initiated the commitment.
On the conference, to serve the development, China Nutrition and Health Food Association signed the strategic cooperation agreement with “the Belt and Road” agriculture and food trade information platform, to jointly push the international integration and development of the health food industry.
about 500 representatives from National Health and Family Planning Commission, Commerce Department and other government departments, relevant international and domestic industry organizations, and industry enterprises attended the conference.
I. Remember the initial determination. Health food industry is one of the important pillar industries of our country’s food industry, and the important industry boosting the construction of healthy China, promoting the development of “Massive Health” industry, and promoting the development of our country’s health service industry and pension industry. The health food industry shall take the promotion of realizing the national strategic goal “Healthy China” as its task, and realize the conscientious production and management to serving the Healthy China by the strategic perspective of massive nutrition, massive health, massive integration and massive development.
II. Observe laws and disciplines. It shall strictly execute the Food Safety Law, the Regulations on Direct Selling Administration, the Health Food Registration and Record Management Measures and other laws and regulations, put the entity responsibility of enterprise quality safety into practice, resolutely implement the basic principle of quality first, truly guarantee to eliminate the false declaration, poor-quality material production, illegal operation and competition with illegal means.
III. Practice and innovation. Take innovation as the main driving power of development, set up it as the industry core competitiveness for future. Take the scientific and technological innovation as the power, and take the health demands as the orientation. By new technology, new product, new mode and new business type, strengthen and boost the innovation breakthrough of health food, promote the transformation of health medical mode, and support the development of health industry.
IV. Benefit people’s livelihood. Actively achieve the professional education and public popularization, communicate scientific knowledge to the public without any cheating or confusion, and completely eradicate the behavior of misleading and deceiving consumers; be aware of normalizing the production and sales behavior, maintain the health food market order, resolutely correct and boycott commercial bribery; effectively build reasonable price system, avoid to whoop up the price or low-price competition; actively take part in social public welfare to give back to the society.
V. Co-construction and sharing. After many years of development, everyone in China’s health food industry is now standing together through storm and stress, and sharing weal or woe. The industry enterprises shall share the responsibilities so as to share the benefits. Strictly follow the policy guidance of the government, guarantee the safety and effectiveness of the health food, jointly construct and develop the industry and market, jointly maintain the overall reputation of the industry, and promote the health level of the public.
