Announcement of the General Administration of Market Regulation on Soliciting Opinions on Adjusting Health Food Functions

   The General Administration of Market Regulation summarized function claims approved in different historical periods and gathered experts from medicine, pharmacy, food, nutrition and other fields to put forward opinions on adjusting function claims for health foods. The purpose is to further strengthen the management of health food functions, prevent false advertising of health food functions, enhance consumers' scientific understanding and accurate judgment of health food function claims, and avoid confusion with function and disease claims. The relevant matters are hereby announced as follows:
  
   First, the first batch of health function statements intended to be adjusted. Experts believe that function claims of some existing health products are inaccurate, falsely or exaggeratedly advertised and prone to mislead consumption, though they are consistent with the existing health food regulatory positioning and health requirements. In order to make function claims more accurate, it is recommended to adjust some function claim statements (see Annex 1 for details). After the release of the document, holders of the health food product registration certificate or authorized manufacturers should adjust function claim statements in the packaging, label and manual of products accordingly. There is no need to apply for a separate change of registration. Products released in the market can be sold until the end of shelf life; as for products under review or approval, the relevant agency will directly adjust function claims, and applicants do not need to make any corrections.
  
  Second, health function statements intended to be cancelled. Experts believe that function claims for some existing health products are incompatible with the current health food regulatory positioning and health requirements, and that products for children, pregnant women, lactating mothers and other vulnerable population should accept more strict regulation to cancel their unproper function claims. Function claims that have been approved but are no longer accepted for review and approval should be cancelled (see Annex 2 for details). After the release of the above-mentioned document, the products with involved function claims should stop production immediately; products that have been produced and do not have quality and safety risks and can be sold until the end of shelf life; the State Administration of Markets Regulation will no longer accept, review and approve products with involved function claims.
  
  Third, health function statements to be further studied and verified. Experts believe that function claims and evaluation methods for some existing health products can be easily confused with disease claims for drugs. It is recommended to further study and verify the existing positioning and statements of some functional claims while soliciting public opinions on this issue. (see Annex 3 for details)
